The company had argued that its patent for Celebrex® would have expired in 2006, and Pfizer and its subsidiary Merck & Co. agreed to settle the litigation and resolve the allegations.
In a filing, Pfizer said that it is “evaluating the outcome of the litigation” and will “seek remedial action as soon as possible.” Pfizer is now seeking to avoid future lawsuits and the potential loss of profits for the company if the litigation is not resolved in the next few years.
Last month, the Food and Drug Administration announced that it was investigating whether Pfizer had a potential interest in pursuing a class action brought by generic drug makers over patents in the United States and other countries. The FDA is currently investigating whether the company had a potential interest in pursuing a class action filed by generic drug manufacturers against the generic drug industry, the company said in a statement.
The company said it has submitted a “confidentiality and transparency” request with the FDA to resolve the questions regarding whether or not a generic or non-generic company can be held liable for the drug’s use by the generic drug industry. The FDA’s Office of Generic Drugs will be able to determine whether or not the company has a potential interest in resolving the case. In its submission to the FDA, the company said that the company was seeking to avoid future lawsuits and that Pfizer had no interest in the settlement.
The company, which has a “significant revenue potential” of $3.7 billion, is currently filing suits for its prescription medicines and is expected to submit new generic drugs by the end of the year. However, it also faces an increased interest in litigation over its over-the-counter drugs in the U. and in the other countries for those products.
In the meantime, the company will continue to fight the litigation.
